Waterfront Rights, Lake, River Government Take Line

 

"Know Your Water Frontage Rights!"

  • Littoral Waterfront Rights - Lake typically, to waters edge.  It stops there in all rights.  The shore is yours, the water is public access for that lakes participants.  Water patrol or county or state police would be your only sense of protection for abuse.

  • Riparian Waterfront Rights - Rivers typically, to the center of the river, owning the land under the water as well as shore and beaches, giving access rights to the navigational rights of paddlers, boaters, to navigate and pass by, (if on a navigational body of water).  The shoreline is indeed private, which riparian easement participants may not stop at, without your permission.

  • Take line - Government controlled easement that private property borders.  These easements are typically nature and waterfront preservation areas.  You do not own frontage in these cases but front the Government surveyed "take line", and may be restricted from even cutting an established path to the water.

Consult your area's Real Estate professionals for your local laws and check the deed for descriptions both legal boundaries with rights and easements provisions.
